1. Information We May Collect

The information Whipsaw collects depends on the features you use.

Account Information

When you create or use a Whipsaw account, we may collect information such as:

• username;
• display name;
• email address;
• account identifier;
• profile settings; and
• account creation information.

Discord Information

If you connect Whipsaw with Discord, we may receive information permitted by the Discord permissions you authorize, which may include:

• Discord user ID;
• Discord username;
• display name;
• avatar;
• server or guild identifiers;
• roles;
• command interactions; and
• other information required to provide the Discord feature you requested.

Whipsaw does not access Discord information beyond the permissions granted to the application and the functionality required to operate the Service.

Game Information

We may process game-related information such as:

• simulated trades;
• portfolio performance;
• scores;
• rankings;
• achievements;
• game progress;
• preferences;
• gameplay history;
• multiplayer room presence, ready state, reconnect status, and match results;
• statistics; and
• interactions with Whipsaw features.

Technical Information

When accessing Whipsaw, certain technical information may be automatically collected, including:

• IP address;
• browser type;
• device type;
• operating system;
• approximate geographic region;
• timestamps;
• referring pages;
• application logs;
• crash information; and
• security and diagnostic information.

Cookies and Similar Technologies

The Whipsaw website may use cookies or similar technologies for:

• authentication;
• maintaining sessions;
• remembering preferences;
• security;
• analytics; and
• improving performance.

Whipsaw may also use browser storage, including local storage, to keep guest profile choices, settings, progress, demo entitlements, and unfinished runs on your device. Clearing site data may delete that information.

Where legally required, we will request consent before using non-essential cookies.

• operate Whipsaw;

• provide Discord and Google sign-in integrations;
• process game actions;
• maintain leaderboards and achievements;

• coordinate cross-platform multiplayer rooms and verify match results;

• secure our systems;
• diagnose technical problems;
• communicate with users;
• provide customer support;
• understand how Whipsaw is used;
• improve gameplay and features; and
• comply with legal obligations.

3. Discord API Data

Information obtained through Discord's APIs is used only for operating functionality associated with Whipsaw.

We do not sell Discord API data.

We do not use Discord API data for advertising, surveillance, or profiling.

Discord's current Developer Terms require developers to limit API-data sharing and delete API data when it is no longer necessary, when Discord or the applicable user requests deletion, or when otherwise required.

4. Google Sign-In Data

When you choose Google sign-in, Whipsaw receives your Google account's stable identifier, display name, and profile image. We use this information only to authenticate you and connect Google as a login method for your Whipsaw Account. Whipsaw does not request access to Google Drive, Gmail, contacts, or calendars.

We do not automatically merge Google and Discord identities based on a matching name or email address.

5. How We Share Information

We may disclose information to service providers that help us operate Whipsaw, including providers of:

• cloud hosting;
• databases;
• authentication;
• security;
• analytics;
• customer support; and
• payment processing, if applicable.

These providers may process information only as necessary to provide their services to Whipsaw.

We share Discord API data only as permitted by Discord's Developer Terms, including with service providers acting on our behalf, when required by law, or when a user expressly directs us to share it.

We may also disclose information when reasonably necessary to:

• comply with applicable law;
• respond to valid legal requests;
• protect users;
• investigate fraud or security incidents;
• enforce our Terms of Service; or
• protect Whipsaw's legal rights.

We may disclose information as part of a merger, acquisition, financing, sale, or restructuring of the business, subject to applicable law. Any transfer of Discord API data will also remain subject to Discord's Developer Terms.

6. Sale of Personal Information

Whipsaw does not sell or share personal information for monetary or other valuable consideration as those terms are defined by applicable privacy laws. We do not sell, license, or otherwise commercialize Discord API data.

If our practices change, this Privacy Policy will be updated and any legally required choices will be provided to users.

7. Data Retention

We retain personal information only for as long as reasonably necessary to:

• provide Whipsaw;
• maintain user accounts;
• maintain security;
• comply with legal obligations;
• resolve disputes; and
• enforce agreements.

Except where retention is required by law, Discord API data will be promptly updated when Discord or the applicable user requests an update and promptly deleted when it is no longer required for Whipsaw's functionality, Whipsaw stops operating the applicable feature, Discord or the applicable user requests deletion, or deletion is otherwise required. Discord API data received in error will be deleted.

Where permitted, backup copies may remain temporarily in secured backup systems until they are overwritten or deleted on the normal backup schedule. This does not extend our use of Discord API data beyond the retention permitted by Discord's Developer Terms.

8. Data Deletion

You may request deletion of information associated with your Whipsaw account.

Include sufficient information for us to identify the account associated with your request.

After verifying the request where necessary, we will delete or anonymize eligible personal information unless retention is required by law or necessary for legitimate security or legal purposes.

Providing users with an accessible method for requesting modification or deletion of Discord API data is specifically required by Discord's current Developer Terms.

9. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, alteration, disclosure, or destruction.

No internet-connected service can guarantee absolute security.

Discord's Developer Terms also require developers to use commercially reasonable safeguards to protect API data, including encryption of API data at rest.

10. Children's Privacy

Whipsaw is not designed for or directed to children under 13. You must be at least 13 years old and meet any higher minimum age required by the laws where you live to use the Service. We do not knowingly collect personal information from, or obtain or transmit Discord API data concerning, anyone below this minimum age.

If we learn that personal information has been collected from a child where parental consent or another legal basis was required, we will take appropriate steps to delete it.

In the United States, COPPA imposes additional requirements on online services directed to children under 13 or that knowingly collect personal information from children under 13.

11. Your Privacy Rights

Depending on where you live, you may have rights concerning your personal information, including the right to:

• request access;
• request correction;
• request deletion;
• obtain a copy of certain information;
• object to or restrict certain processing; and
• withdraw consent where processing relies on consent.

Certain jurisdictions provide additional privacy rights.

12. International Users

Whipsaw may be available to users in multiple countries.

Where required by law, appropriate measures will be used when personal information is transferred between jurisdictions.

13. Third-Party Services

Whipsaw may interact with services operated by third parties, including Discord.

Those companies maintain their own privacy practices, and information processed directly by them is governed by their respective policies.

14. Changes to This Privacy Policy

We may update this Privacy Policy as Whipsaw develops or legal requirements change.
