1. About Whipsaw

Whipsaw is a trading-themed game, arcade experience, and market simulator designed for entertainment and educational purposes.

Whipsaw may simulate stocks, options, futures, market events, economic reports, earnings announcements, news events, technical analysis, trading strategies, and other financial-market concepts.

Whipsaw is not a brokerage, investment adviser, financial adviser, exchange, or financial institution.

2. Not Financial Advice

Nothing available through Whipsaw constitutes investment, financial, legal, tax, or trading advice.

Information presented within the Service, including simulated prices, charts, market data, indicators, strategies, rankings, news events, trading scenarios, or AI-generated content, is provided for entertainment and informational purposes only.

You should not make real-world investment or trading decisions solely based on information presented by Whipsaw.

Past or simulated performance does not guarantee future results.

Trading stocks, options, futures, cryptocurrencies, and other financial instruments involves substantial risk and may result in the loss of some or all invested capital.

3. Eligibility

You must be at least 13 years old and meet any higher minimum age required by the laws where you live to use the Service. Whipsaw is not designed for or directed to children under 13.

If you have not reached the age required to enter into a legally binding agreement where you live, your parent or legal guardian must review and agree to these Terms on your behalf and supervise your use of Whipsaw.

Certain third-party services, including Discord, may impose additional or country-specific age requirements.

4. User Accounts

Some Whipsaw features may require you to create an account or connect a third-party account such as Discord.

You are responsible for:

• promptly notifying us if you believe your account has been compromised.

5. Discord Integration

Whipsaw may integrate with Discord to provide features including authentication, game activity, commands, statistics, leaderboards, achievements, community features, or other functionality.

Your use of Discord remains subject to Discord's own terms, policies, and community guidelines.

Whipsaw is an independent application and is not endorsed by, sponsored by, or affiliated with Discord unless expressly stated otherwise.

6. Acceptable Use

You may not use Whipsaw to:

• violate applicable laws or regulations;
• exploit bugs or vulnerabilities;
• cheat, manipulate rankings, or circumvent game systems;
• interfere with Whipsaw servers or infrastructure;
• access another user's account or data without authorization;
• distribute malware or malicious code;
• scrape or automatically extract data except where expressly permitted;
• reverse engineer protected portions of the Service except where permitted by law;
• harass, threaten, abuse, or impersonate other users; or
• use Whipsaw to facilitate actual market manipulation, fraud, or other unlawful financial activity.

We may suspend or terminate accounts that violate these rules.

7. Virtual Currency, Points, and Game Items

Whipsaw may provide virtual cash, simulated trading capital, points, rankings, achievements, items, rewards, or other digital game elements.

Unless explicitly stated otherwise, these items:

• have no real-world monetary value;
• cannot be redeemed for cash;
• do not represent securities or financial instruments;
• are not deposits or investments; and
• may be modified, reset, removed, or rebalanced as part of the game.

8. Simulated Market Data

Whipsaw may use simulated, delayed, historical, generated, licensed, or third-party financial-market information.

We do not guarantee that market information displayed by Whipsaw is accurate, complete, current, or suitable for real-world trading.

Certain market data may be delayed or modified for gameplay purposes.

9. Intellectual Property

Whipsaw and its associated software, graphics, user interfaces, designs, logos, branding, game mechanics, text, audio, and other original content are owned by Whipsaw or its licensors and are protected by applicable intellectual-property laws.

You receive a limited, revocable, non-exclusive, non-transferable license to use Whipsaw for personal use in accordance with these Terms.

No ownership rights are transferred to you.

10. User Content

If Whipsaw allows you to submit usernames, posts, messages, images, strategies, feedback, or other content, you retain ownership of your content.

You grant Whipsaw a non-exclusive license to host, process, display, and use that content as reasonably necessary to operate and improve the Service.

You are responsible for ensuring that content you submit does not violate the rights of others.

11. Third-Party Services

Whipsaw may rely on or link to third-party services, including Discord, market-data providers, hosting providers, analytics services, payment processors, and other platforms.

We are not responsible for third-party services, their availability, or their independent privacy and security practices.

12. Service Availability

We may modify, update, suspend, discontinue, rebalance, or remove parts of Whipsaw at any time.

We do not guarantee uninterrupted or error-free availability.

Game progress, rankings, statistics, simulated accounts, or other data may occasionally be reset or changed because of updates, technical problems, testing, abuse prevention, or gameplay balancing.

13. Disclaimer of Warranties

To the fullest extent permitted by law, Whipsaw is provided "as is" and "as available."

We make no guarantee that the Service will:

• always be available;
• be free from errors or security vulnerabilities;
• produce accurate financial-market information; or
• meet any particular financial, trading, or investment objective.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Whipsaw and its owners, developers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages resulting from your use of the Service.

This includes losses arising from real-world trading or investment decisions made based on information, simulations, strategies, statistics, or content presented through Whipsaw.

15. Account Suspension and Termination

We may suspend or terminate access to Whipsaw if we reasonably believe a user has violated these Terms, abused the Service, created security risks, or engaged in fraudulent or unlawful activity.
